List Serve members,

Some of you may have heard recent news stories about the IRS issuing a noti ce about automatic revocation of non-profit status for tax-exempt organizat ions who have not filed for three consecutive years. The recent news storie s from MN mention that as many as 4,000 non-profit organizations may be at risk of losing their status in that state.

Most tax-exempt organizations, other than churches, must file a yearly retu rn or notice with the IRS. If an organization does not file as required for
 three consecutive years, the law provides that it automatically loses its tax-exempt status. Loss of exempt status means an organization must file in come tax returns and pay income tax, and its contributors will not be able to deduct their donations.

The critical deadline is May 17 for organizations that use the calendar yea r as their fiscal year. What must be filed this year depends on the organiz ation’s financial activity.

(In the past, non-profits whose gross receipts totaled less than 25,000 per
 year were exempt from filing, but that rule has changed. All organizations
 must file a 990, although if gross receipts are less than 25,000, then you
 may file the 990-N, the e-postcard.)

The WHS cannot check on your status on your behalf - if there is a question
 if your organization is in compliance, please contact the IRS directly.
